These terms are an agreement between you and [LEGAL ENTITY NAME] ("Scale Summit", "we"), located at 8732 Snowbird Way, Parker, CO 80134. They cover your use of Scale Summit AI, an AI creative tool for e-commerce marketing. By using the service or buying credits, you accept them.

The service

Scale Summit generates marketing material from what you enter. The tools shown on the site are marked as coming soon until they open.

Availability

Scale Summit hasn't launched yet. Tools and checkout are marked as coming soon until they open, and nothing is charged before then.

Eligibility and business use

You must be at least 18 and able to enter a contract. If you use the service for a company, you confirm you can bind that company.

Credits

• Credits are prepaid units you spend on Scale Summit generations. The cost of each generation is shown before you run it.
• Credits can only be used on Scale Summit tools. They aren't money, can't be exchanged for cash or for third-party goods or services, and can't be transferred or resold.
• Credits don't expire while the service is operating.
• You're only charged credits for a generation that completes successfully.

Payment and refunds

Prices are in US dollars and are shown before you pay. Purchases are one-time, with no subscription. Taxes may apply where required. Refunds follow our Refund Policy.

Your content and the output

You keep your rights in what you submit, and you confirm you have the right to use it. As between you and Scale Summit, you own the output and may use it commercially. We only use your content to run the service, as described in our Privacy Policy.

Your responsibility for output

AI output can be wrong, and similar output can be generated for other customers. Review everything before you publish it. You're responsible for making sure your ads are accurate, lawful and allowed by the platforms you run them on.

Acceptable use

You must follow our Acceptable Use Policy. We may refuse a generation, or suspend your access, if you break it.

Service changes

We may change or discontinue features. If we shut down the paid service, we'll refund unused paid credits at the price you paid for them.

Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee sales or advertising results.

Limit of liability

To the extent the law allows, we aren't liable for indirect or consequential losses, or lost profits. Our total liability is limited to what you paid us in the 12 months before the claim.

Governing law

These terms are governed by the laws of Colorado, without regard to its conflict of law rules.
